Tallahassee, Fla. – Today, Florida Commissioner of Agriculture and Consumer Services Nikki Fried , an independently-elected member of the Florida Cabinet, is calling on Governor Ron DeSantis to issue an emergency declaration to help combat the high cost of food and gas in Florida, which will empower the Florida Department of Agriculture and Consumer Services (FDACS) to then take emergency action under its gasoline regulatory authority. This morning, Commissioner Fried held a press conference on this call to action, and the video can be viewed here.
The letter reads in part: “If a state of emergency is issued, my Department would then be able to issue an emergency order suspending statutory provisions in Chapter 526, Florida Statutes, that prohibit gasoline retailers from selling gasoline below cost to customers. We need to be doing everything possible to help lower prices for Floridians in need, and I am eager to take this step to lower gas prices – which my Department can only take during a state of emergency.”
Background: Commissioner Fried and the dedicated officers of the FDACS Office of Agricultural Law Enforcement and the inspectors of the FDACS Division of Consumer Services have made protecting Floridians at the pump a top priority. They have protected consumers and businesses from crimes such as gas pump skimmers, pump tampering, and fuel theft. Additionally, just last week, Commissioner Fried announced an emergency rule allowing all fuel suppliers to utilize additional fuel types to secure a consistent fuel supply and alleviate additional strain Florida’s fuel market.

I am writing to urge you to issue an emergency declaration due to the high cost of food and gas in Florida. Gasoline and grain prices have risen as a direct result of Vladimir Putin’s unprovoked war in Ukraine, and lingering supply chain issues from the pandemic have caused an increase in other food commodities.
If a state of emergency is issued, my Department would then be able to issue an emergency order suspending statutory provisions in Chapter 526, Florida Statutes, that prohibit gasoline retailers from selling gasoline below cost to customers. We need to be doing everything possible to help lower prices for Floridians in need, and I am eager to take this step to lower gas prices – which my Department can only take during a state of emergency.
